Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the website, apps, and services provided by Starwardz LLC (“Starwardz”, “we”, “us”). By accessing or using any Starwardz product, you agree to be bound by these Terms.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use our services. If you are using our services on behalf of an entity, you represent that you have authority to bind that entity.

3. Accounts & Security

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activities that occur under your account.
  • Notify us immediately of any unauthorized use or suspected breach of security.

4. License & Acceptable Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use our apps and website for personal or internal business purposes. You agree not to:

  • Reverse engineer, decompile, or attempt to access source code (except where permitted by law).
  • Bypass or interfere with security features or rate limits.
  • Use the services in any unlawful, harmful, or abusive manner, including fraud or spam.
  • Sell, sublicense, or redistribute the apps except as expressly permitted.

5. Purchases, Subscriptions & Billing

  • Prices, features, and availability may change at any time.
  • Subscriptions renew automatically unless canceled in accordance with the platform’s cancellation process.
  • Taxes may apply based on your billing address.
  • Refunds are handled per our Refund Policy and app store rules.

6. User Content

You retain ownership of content you submit to the services. You grant Starwardz a worldwide, non-exclusive, royalty-free license to host, process, and display your content solely to operate and improve the services. You represent you have the rights necessary to grant this license and that your content does not infringe others’ rights.

7. Privacy

Our practices are described in the Privacy Policy, which is incorporated into these Terms. By using the services, you consent to our data practices.

8. Intellectual Property

The services, including software, designs, trademarks, and content provided by Starwardz, are owned by or licensed to Starwardz and are protected by intellectual property laws. Except for the limited license in Section 4, no rights are granted to you.

9. Third-Party Services

Our apps may integrate with third-party services (e.g., app stores, analytics, authentication). Your use of those services is governed by their respective terms and policies.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the services will be uninterrupted, secure, or error-free.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STARWARDZ AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES.

12. Indemnification

You agree to indemnify and hold Starwardz harmless from any claims, liabilities, damages, and expenses, including reasonable attorneys’ fees, arising out of your use of the services or violation of these Terms.

13. Suspension & Termination

We may suspend or terminate your access if you violate these Terms or if we believe your use poses risk to us or others. Upon termination, your license to use the services will cease immediately.

14. Governing Law

These Terms are governed by the laws of the State of Iowa, USA, without regard to its conflict of laws rules. Venue and jurisdiction shall lie in courts located in Iowa, USA.

15. Changes to Terms

We may update these Terms from time to time. If changes are material, we will provide notice by posting an update on this page and updating the “last updated” date. Continued use of the services after changes become effective constitutes acceptance.
